45-year-old man sentenced to life for committing an act of incest

A 45-year-old man from Kwale on Wednesday sentenced to life imprisonment for committing an act of incest on his 13-year-old daughter, contrary to Section 20(1) of the Sexual Offences Act No. 3 of 2006.

He was also convicted of an indecent act, contrary to Section 11(A) of the Sexual Offences Act No. 3 of 2006.

The accused committed the offences on diverse dates between January 2019 and 26th March 2023 at Nyacha village, Taru location within Kwale County.

During the trial, the prosecution, through Prosecution Counsel Annette Wanjohi presented five witnesses, including the minor, whose evidence the court held established the prosecution’s case beyond reasonable doubt.

Mariakani Senior Resident Magistrate Hon.Olivia Koranje dismissed the accused defense that he was framed by his wife as baseless, since the medical report concurred with the testimonies of witnesses.

During the trial, it emerged that the accused had been convicted and jailed for a five-year jail term between 2010 and 2015 for sodomizing his wife. 

Hon. Koranje held that the accused’s behavior did not change despite his previous conviction and sentence, hence warranting the court to grant him the length of his sentence.

Meanwhile a Kangundo court yesterday sentenced a man to 15 years in prison for defilement of a minor. Alloys Waema Ndunge committed the offence on 1st November 2021 at Kikambuani Trading Centre , Kangundo Subcounty, within Machakos County.

In her judgement, Hon. Sure ruled that the prosecution, led by Prosecution Counsel Mirriam Mwaura and Salome Koinnet, proved its case to the standard provided under the law.

The prosecution called a total of four prosecution witnesses in support of its case who gave collaborative evidence against the accused.
