Do you remember the #MeToo movement campaign started 2017 by women in Hollywood which spread beyond the industry?
Well, the inspiration behind this was American film producer Harvey Weinstein who was eventually sentenced to 23 years in prison in 2020 at the height of Covid-19 after being found guilty of rape.
Harvey allegedly raped two women. A judgement by New York’s Court of Appeal has however taken many aback after it overturned the verdict.
The New York top court found that Harvey was tried on evidence based on past behavior as opposed to the facts of the case.
Four judges in the seven bench court held that the court admitted testimonial evidence of the alleged prior sexual acts “other than the complainants of the underlying crimes.”
Additionally, the court held that the trial judge allowed Harvey to be cross-examined in a manner that portrayed him in a “highly prejudicial” light.
“The remedy of these egregious errors is a new trial,” the judgement read in part. One of the three dissenting judges however criticized this verdict opining that it “thwarted the steady gains survivors of sexual violence have fought for in the criminal justice system.”
Harvey was convicted of rape in 2023 by a California court for 16 years in prison. He continues to serve this sentence.
