Another impeachment motion against Governor Kawira Mwangaza to be tabled today

Another impeachment motion against Meru governor Kawira Mwangaza is set to be tabled in the County Assembly on Wednesday July 31, 2024 during the afternoon session.

This is after a similar impeachment motion against governor Mwangaza was withdrawn yesterday.

“Wednesday, July 31, 2024 (Afternoon Sitting) (570) Supplementary Order Paper purposes of considering the Special Motion for removal from office of the Governor Meru County, Hon. Kawira Mwangaza, by way of Impeachment,” read part of the County Assembly order paper.

“Aware that, a Notice of Motion for the removal from office of the Governor Meru County, Hon. Kawira Mwangaza, by way of impeachment pursuant to the provisions of Article 181 of the Constitution of Kenya, 2010, Section 33 of the County Governments Act, 2012 and Standing Order No. 65 during today’s Afternoon Sitting,” the MCAs noted.

In drafting the motion, Meru MCAs noted that they were guided by Standing Order No. 65 (3) of the County Assembly of Meru.

Meanwhile, the High Court in Meru on July 24, 2024 evening had issued a temporary suspension of the impeachment process against Governor Kawira Mwangaza, which was to be debated on Thursday, July 25.

This decision, rendered by Justice L. Kassan, follows a petition filed by Governor Mwangaza, who argued that her constitutional right to a fair hearing was being compromised.

In his ruling, Justice Kassan underscored the importance of due process in political proceedings, stating, “An impeachment is a process that directly engages a person to be impeached, and the right to a fair hearing must always be upheld.”

On the other hand, after withdrawing a similar impeachment motion against governor Mwangaza, the Njuri Njeke council of elders were tasked with the responsibility of finding a solution to the conflict between the governor and MCAs.

However, a section of the Njuri Njeke elders noted that that they do not have the constitutional mandate to resolve the disputes involving the governor and MCAs.
