Baringo: Man in court after defiling 10-year-old girl

A middle aged man who allegedly defiled a 10-year-old minor was arraigned in Kabarnet Law court, Baringo County on February 29, 2024.

The man Dennis Kibet was charged for intentionally defilling a minor on February 3, 2024.

The unfortunate incident occured at around 9 pm at Sessio Village in Baringo North sub county contrary to section 8(1) as read with section 8 (2) of the Sexual Offences Act No 3 of 2006.

Among the pending charges, the accused is facing another charge of committing an indecent act with a child contrary to section 11(1) of the sexual offences Act No. 3 of 2006.

After the charges were read to him before the Resident magisterate (RM) Edwin Mulochi, the man pleaded not guilty terming the allegations as false.

What the Baringo court decided

The prosecution counsel Beatrice Bartilol supplied the court with witness statements and dully filled P3 form.

She later objected to the accused being freed on bond terms stating that the accused was a flight risk.

The minor didn’t appear in court as she feared for her security.

The man has been reported to be violent and the counsel pleaded with the court to grant the case a nearer date for the minor to testify.

This is before the accused is released on bond.

The idea of bond cancellation was seconded  by Police constable Henry Owiti of the Kabartonjo Police station.

In a signed affidavit, police stated that the accused was a flight risk who was arrested by members of the public at the Marigat sublocation in Baringo .

In the affidavit it was also stated that the complainant and five witnesses feared testifying against the accused if he was to be freed.

Resident Magistrate Edwin Mulochi gave final orders for the case to be mentioned on March 15 and the hearing to be slated on March 23 with the five witnesses set to testify on that day.
