Embattled Deputy Governor Rigathi Gachagua has been dealt another blow after the High Court, for the second time, declined to grant orders stopping his impeachment proceedings.
A petition filed by former senator Cleophas Malala was on Monday, October 7 mentioned before Justice Bahati Mwamuye.
However, Justice Mwamuye directed that the matter be placed before High Court’s presiding judge, justice Chacha Mwita, for further directions.
Meanwhile, the National Assembly has made an application seeking to have all petitions challenging the impeachment process of DP Gachagua be consolidated.
The National Assembly argues that the matters raise similar issues and should be consolidated into one for more efficiency in hearing and determining them.
“There are so far before the High Court in Nairobi and other stations across the country thirteen (13) Petitions all challenging the removal by impeachment of H.E Rigathi Gachagua as the Deputy President of the Republic of Kenya,” reads the application.
In his petition, Malala argued that the bicameral Parliament (National Assembly and Senate) is unconstitutional because it lacks the requisite 2/3 Gender Rule threshold.
