The High Court on Monday, March 4 ruled that the recent recruitment by Kenya Revenue Authority (KRA) was unconstitutional.
The tax man, on June 2023 recruited 1,406 revenue service assistants. However, the court found out that a bigger percentage of the slots were allocated to two communities, in clear violation of the Constitution.
Justice William Musyoka, in his ruling, noted that the recruitment had offended the Constitution and the provisions of articles 10, 27, 56 and 232.
These provisions of the Constitution touch on diversity, inclusion and regional balance when it comes to state bodies recruiting its staff.
Subsequently, Justice Musyoka barred KRA from recruiting and appointing staff at all levels, until an ethnic diversity and regional balance policy is put in place.
This policy, the judge said, should be in place within 30 days
