Narok nominated Member of County Assembly (MCA) Ms. Alice Chepkirui Kering has suffered a big blow after the Court of Appeal sitting in Nakuru upheld a judgement made by the High Court to nullify her nomination.
The nullification followed a successful election petition by Ms. Josephine Seneiyo Torome who argued that Ms. Kering, who had been nominated by the Jubilee Party belonged to ODM Party.
Further, Ms. Torome proved that the nominated MCA hailed from Nakuru County, where she is a registered voter but was nominated in Narok County.
Martin Kamwaro, the lawyer who represented MS. Torome said her client had challenged the nomination of Ms. Kering in the gender top up list and won the case in the chief magistrate and high courts.
The case was appealed in the Court of Appeal where the court upheld the ruling of the lower courts on the grounds that, the end of the road for an appeal arising from the MCA’s election petition is the high court.
“My client Ms. Torome, being the next person in the gender top-up list from the Jubilee Party and should be sworn in as the nominated MCA within the Jubilee party list that had been subjected to Independent Electoral and Boundaries Commission,” he said.
He said the victory is not only for Ms. Torome, but for the entire women in the county who did not have a proper representation.
Ms. Torome, who was backed by her family members, expressed her gratitude to the courts for giving her justice saying she will use her position to empower her fellow women financially.
“I will do my best to empower my fellow women and the vulnerable children in my community. I am grateful that the seat is coming back to me,” she said.
Following the judgement, the Narok County Speaker Davis Dikirr is expected to swear in office Ms. Torome as he nullifies the seat of Ms. Kering.
