Families that lost their loved ones in the Nakuru-Eldoret highway accident may not be compensated for the tragedy, following the revelation that the bus belonging to Classic Kings of Congo that caused the accident killing 15 people may have been involved in insurance fraud.
It has now come to light that the bus insured with Invesco Assurance Limited was registered as a lorry, not a PSV.
This has also opened up the insurance company to an investigation by the Insurance Regulatory Authority (IRA) and possible litigation because this means some company staff members may have been involved in foul play and possible corruption.
According to the local publication Taifa Leo a private investigator Daniel Muteshi, found out the Lorry insurance was registered in May 2023 for Ksh 9000.
On Tuesday at 2:00 am the carnage involving the bus belonging to Classic Kings of Congo and North Ways Shuttle Toyota Matatu saw 15 people lose their lives and 18 out of the 45 passengers in the bus injured badly.
On Wednesday night the driver of the bus was arrested and on Thursday morning present at Molo Law Courts where he was charged with 15 counts of murder 1 count of contravening the use of insurance, 1 charge of reckless driving and one other charge of carrying 41 uninsured passengers.
According to preliminary investigations the 34 -year-old driver was trying to overtake another vehicle and ended up colliding with an oncoming matatu.
Clement Kiarie, the driver of the ill-fated bus was later freed on a Ksh 1 million bond after he denied the charges.
The Magistrate also allowed the defendant to seek medical attention as he was among those injured in the January 9th accident.
