The Director of Public Prosecutions (DPP) has withdrawn charges against President Yoweri Museveni’s son, General Muhoozi Kainerugaba.
Trial Chief Magistrate at Buganda Road Court Ronald Kayizzi withdrew charges of disobedience and common nuisance against Gen. Muhoozi after receiving orders from the DPP.
“I have perused through the withdrawal form, the DPP has decided to withdraw the charges against Gen Muhoozi and I have also heard the reasons given by the state that a year now there is no credible evidence by the complainant, and under article 23 (d) of the constitution, I accept the withdrawal and the charges against Muhoozi are hereby withdrawn,” ruled Kayizzi.
However, the court ruling was objected to by Male Mabirizi who had initially filed the case against Muhoozi.
This was after Mabirizi was denied the chance to express his opinion in court about the withdrawal of the charges against President Museveni’s son.
“The Magistrate has allowed to withdraw the case without hearing from me as a person who filed it yet my consent was needed before the case was withdrawn,” said Mabirizi.
Mabirizi argued that according to Uganda’s constitution, the DPP Justice Jane Frances Abodo has the power to take over a case and proceed with it but not to terminate it.
“This is the reason as to why I have been challenging these takeovers by the DPP because they end up killing the cases,” he said.
“We are going to the High Court to challenge the withdrawal and refusal for stay over proceedings,” he added.
Mabirizi filed the charges against Muhoozi in November 2022, alleging that he addressed a political gathering at Kololo in Kampala yet he was serving in the military.
He cited the constitution of Uganda which prohibits officers from the Uganda People’s Defence Forces (UPDF) from being involved in political activities.
