Man, 48, imprisoned for life for defiling nine-year-old girl

A Mombasa court found a 48-year-old man guilty of defilement and sentenced him to life imprisonment. The man defiled a nine-year-old girl.

The perpetrator had made an application to court that he be given a non-custodial sentence. Principal Magistrate Martin Rabera denied his application arguing he was not deserving.

"Mombasa Principal Magistrate, Hon. Martin Rabera ruled that the prosecution had proven beyond a reasonable doubt that the accused defiled the minor," a statement by the Office of the Director of Public Prosecution read in part.

Rabera observed that the victim was brave while testifying despite being terrified by her tormentor. 

"Hon. Rabera further ruled that the complainant gave strong testimony and was not shaken by who had defiled her, despite the fact that she seemed terrified of the accused person."
