Court allows EACC to sell 8 prime properties, 2 vehicles of  former Migori governor Okoth Obado

The High Court has allowed the Ethics and Anti-Corruption Commission (EACC)  to seize and sell by public auction 8 prime properties and 2 high end motor vehicles belonging to former Migori Governor Okoth Obado, his children and associates.

During the court ruling on Tuesday June 19, 2024, the court allowed the commission to sell Obado’s property, noting that the items were proceeds of corruption and unexplained wealth allegedly stolen from Migori County Government. 

In the consent judgement delivered in the civil forfeiture case by Justice Esther Maina on Tuesday, the High Court adopted an Alternative Dispute Resolution (ADR) settlement reached by the parties. 

However, the consent judgement does not affect the ongoing criminal case against the former Governor and his children, whose cumulative direct benefit from the fraudulent scheme was to the tune Ksh73 million.

Among the properties to be seized by EACC in the Ksh235 million forfeiture is a residential home worth Ksh40 million linked to Obado in Loresho.

“And whereas pursuant to financial investigations undertaken, the Commission established between the financial years 2013-2017, the 16 Defendant companies received a total of Ksh 1,978,592,467 being public funds from the County Government of Migori through tenders. 

“Investigations also established that a total of Ksh 73,474,376.90 was received by various persons that the Commission suspected was indirectly for the benefit of the Governor, County Government of Migori (2013-2017) Hon. Okoth Obado,” read part of the court papers.
