Court blocks arrest of Gachagua allies over allegations of funding Gen Z protests

The High Court on Tuesday August 6, 2024 issued orders stopping the police from arresting two members of parliament (MPs) accused of funding the Gen Z protests in the country.

Embakasi North MP James Gakuya and his Embakasi Central counterpart Benjamin Gathiru were on July 31, 2024 picked from Parliament buildings and interrogated over allegations of sponsoring Gen Z protests.

MPs James Gakuya and Benjamin Gathiru had filed a case in court seeking to stop their arrest. 

The two MPs are close allies of Deputy President Rigathi Gachagua.

High Court Judge Justice Chacha Mwita on Tuesday issued orders stopping the arrest and detention of the two MPs.

“That in the meantime, a conservatory order is hereby issued restraining the respondent, their agents or servants from arresting, detaining, confining, pursuing and or in any other way interfering with the petitioner’s liberty in connection with the allegations giving rise to this petition,” ruled Justice Mwita.

In addition, the Judge explained that the court will issue more directives about the matter on September 17.

Police had also interrogated other Gachagua allies including three aides in connection with funding of the protests in Nairobi and other parts in the country.
