Court  clears EACC to investigate former Governor Evans Kidero’s bank accounts

The Court of Appeal has given the Ethics and Anti-Corruption Commission (EACC) the green light to investigate former Nairobi Governor Evans Kidero’s bank accounts.

The investigation stems from allegations of abuse of office during his tenure as governor and his previous role as Managing Director of Mumias Sugar Company.

Kidero had filed a petition to block the EACC from accessing his bank accounts, arguing that the commission had overstepped its authority to investigate him.

During his time in public office, the former governor was accused of amassing millions of shillings irregularly.

In response, the EACC sought to probe his six bank accounts to determine if any financial misconduct had occurred.

In his appeal, Kidero contended that the EACC acted beyond its legal powers by investigating his accounts and obtaining court orders to access them.

However, the three-judge bench overseeing the appeal ruled in favour of the EACC, allowing them to continue their investigation.

The ruling, delivered on Friday, September 20, dismissed Kidero’s attempt to prevent the probe.

The legal battle began in 2016 when the EACC first obtained orders from the Chief Magistrate’s Court to access Kidero’s bank records.

Kidero responded by moving to the High Court, seeking to block the commission’s investigation.

After the High Court dismissed his application, he took the case to the Court of Appeal, hoping to halt the inquiry.

With the Court of Appeal’s ruling, the EACC is now free to conclude its investigation and determine whether Kidero engaged in any irregular financial activities during his time in office.
