Court declines to lift orders freezing Wilson Kanani’s property worth Ksh643M

KENYA

The high court has declined to lift orders freezing property of Nairobi County employee Wilson Nashon Kanani, worth Ksh643 million.

This was after the Anti-Corruption court in Nairobi granted orders on September 13, 2023 allowing freezing of Kanani’s assets pending hearing and determination of the case filed by EACC.

EACC had explained to the court that Kanani, was unable to explain the source of his wealth worth Ksh643 million, hence the suspicion that he acquired the property through corruption.

Lady Justice E.N Maina issued the orders barring Kanani from accessing his property including motor vehicles, parcels of land and Ksh48 million in bank accounts.

Through his lawyers, Kanani filed an application on September 25, 2023 seeking to overturn the ruling that ordered freezing of his assets.

“On 7th February 2024 vide a ruling delivered in court by Justice Sifuna, the court declined to discharge the interim orders and thereby dismissed the Respondents’ application.

“The court further directed that the orders by Justice Maina shall continue to abide until the logical conclusion of the matter,” EACC noted in a statement.

Wilson Nashon Kanani who was earning a monthly gross salary of Ksh. 88,530.00 had accumulated assets whose value is above his known legitimate sources of income.

“Investigations by the Commission established that the said Wilson Kanani is a public officer employed at Nairobi City County Government as a Development Control Officer II  earning a monthly gross salary of Ksh85,630.00/- and a net of Ksh 55,866.75/-monthly,” EACC noted in a statement.

His duties as a Development Control Officer II include regulation of outdoor advertisement, monitoring and surveillance of all outdoor advertisement and calling advertisers to comply with approvals and payments for advertisements.

According to the EACC, Wilson Kanani abused the position of trust he was occupying at the Nairobi City County Government by receiving revenue meant for the Nairobi City County Government through bank accounts held by his private companies and spouse.
