Court extends stay orders suspending Governor Kawira Mwangaza impeachment

The High Court has declined to lift orders suspending the Senate’s decision to impeach Meru Governor Kawira Mwangaza. 

During a ruling on Wednesday December 18, 2024 at Milimani Law Courts in Nairobi, Justice Bahati Mwamuye stated that the stay orders should be extended for 120 days pending the hearing and ruling of the case. 

“Ex Parte conservatory orders issued by court on 21st August are confirmed and extended for 120 days and in that time, the petitioner shall continue to serve as governor of Meru County with a proviso that the judgement may be rendered before the lapse of the days,” Justice Mwamuye ruled.

In addition, the Judge ruled that each party in the case should bear their own costs.

At the same time, the judge explained that the decision to uphold the orders issued by the High Court in Meru allowed Mwangaza to continue discharging her duties in full capacity as Meru governor before the hearing and ruling of the case challenging her impeachment.

The Judge also emphasized that the aspect of public interest was a significant factor in the delivery of the ruling.

Governor Mwangaza was impeached on August 21, 2024 after the Senate upheld her impeachment for gross misconduct, abuse of office and gross violation of the Constitution.

Her impeachment was confirmed by Senate Speaker Amason Kingi, who announced the results of the vote on the floor of the House.
