Court freezes Ksh62M seized from former CS Ukur Yatani’s nephew

The Ethics and Anti-Corruption Commission (EACC) has obtained orders from the High Court freezing USD 460,000 (Ksh62,100,000) seized from former Treasury cabinet secretary Ukur Yatani’s nephew, Ibrae Doko Yatani.

EACC noted in a statement that freezing of Ksh62 million from Doko Yatani was part of the ongoing investigation targeting former Treasury CS and Marsabit Governor Ukur Yatani. 

The freezing orders, which were issued by Justice Esther Maina on Friday May 3,  2024, will be in force for a period of six months. 

In court papers, EACC told the High Court that possession of the amount was raising reasonable suspicion that the money may constitute proceeds of corruption or unexplained wealth or that the respondent is engaged in money laundering hence the need to investigate the source.

The Court heard that during the period of interest, Ibrae Doko Yatani, through his company called Al Habib Enterprises, irregularly received Ksh 71,790,897 from the County Government of Marsabit.

Through its Advocate Jackie Kibogy, EACC further told Justice Maina that it is apprehensive that unless the Court issues an order authorizing the continued custody of the cash, Ibrae Doko Yatani may demand unconditional release and proceed to dispose of or transfer the cash thereby frustrating any intended forfeiture proceedings to the detriment of the public. 

The amount will also be used as an exhibit in the event criminal charges are preferred. 

The commission further disclosed that Ukur Yatani together with top Marsabit County officials and close family members are under investigations for theft of public funds, abuse of office, procurement irregularities, conflict of interest and unexplained wealth.
