Court halts dismissal of six Kericho County CECs

The Employment and Labour Relations Court in Nairobi has issued a temporary conservatory order halting the dismissal of six Kericho County Executive Committee (CEC) members whose contracts were prematurely terminated by Governor Dr. Erick Mutai.

In the case filed under ELRCPET/E002/2025, petitioners Brian Cheruiyot Langat, Malel John Kipruto, and four others contested the termination of their contracts, originally set to expire on September 10, 2027, but now slated to end on January 24, 2025.

Presiding over the matter on January 8, 2025, Justice Jemimah Keli, upon reviewing the petitioners’ application dated January 7 2025, certified the case as urgent.

The court issued orders restraining the appointment of new nominees to replace the petitioners until the case is heard inter partes.

The orders include:

  1. Certification of the matter as urgent.
  2. A temporary conservatory order preventing the appointment of replacements for the petitioners.
  3. A directive requiring the respondents to respond to the application within 14 days.

The case is scheduled for a hearing on January 23, 2025.
