The High Court in Eldoret has ordered for a forensic examination of a contested will left behind by the late prominent politician and farmer Mzee Jackson Kibor.
In his ruling, Justice Reuben Nyakundi gave the Directorate of Criminal Investigations (DCI) the liberty to collect samples, tools and writings from Mzee Kibor’s estate, to aid in the forensic examination of the contested will.
“The executioner in possession of the original copy of the testers Will produce and submit it via personal delivery to the DCI domiciled along Kiambu Road for the same to be subjected to forensic examination,” Justice Nyakundi ordered.
Tussle over vast estate
In the case, two surviving wives of Mzee Kibor and their 27 children have teamed up against his youngest wife Eunita Kibor. They are arguing that the contents of the said will do not reflect the final wishes of the late Mzee Kibor.
They also argue that the late tycoon was not of sound mind at the time of writing the will, and that he made it under instruction of Eunita when their representatives were not present.
Represented by a battery of lawyers among them Ken Maiyo and Nixon Koitui, the petitioners want the court to set aside the document.
Mzee Kibor died in March 2022 aged 88 years. He left behind a vast estate across three counties, which is the subject of the tussle between his surviving family members.
