High Court Judge Justice Chacha Mwita on Thursday January 23, 2025 declined to set aside orders requiring Police IG Douglas Kanja and DCI boss Mohamed Amin to appear in court over the alleged abduction of three men in Mlolongo, Machakos County.
This was after the Police IG and DCI boss sought to have the orders set aside claiming they were not served.
However, during the ruling on Thursday, the court found that Inspector General of Police, Douglas Kanja, and Director of Criminal Investigations (DCI), Mohamed Amin, were properly served with court orders requiring them to appear in court regarding the Mlolongo three abductees case.
“I’m not persuaded that the email address used was not the confirmed email address or that they were not served. The pleadings were received, which is why they were represented in court,” said Justice Mwita.
The two police bosses were ordered to explain their alleged involvement in the controversial abduction cases of several young men or face imprisonment.
The court had previously ordered Kanja and Amin, along with George Njao, the Director-General of the National Youth Service (NYS), to attend court proceedings over the disappearances of Billy Munyiri Mwangi, a college student, Ronny Kiplangat (the brother of cartoonist Kibet Bull), content creator Bernard Kavuli, and Peter Muteti, as well as the still-missing Bernard Kavingo.
These cases have sparked widespread outrage and calls for accountability in the country.
The three young men Justus Mutumwa, Martin Mwau, and Karani Mwema were allegedly arrested on December 16, 2024, but their whereabouts remain unknown, with their families pleading for answers.
Following the ruling, IG Kanja and DCI Amin have been ordered to appear in court on January 30, 2025 to explain their involvement in the abductions of Mutumwa, Mwau, and Mwema.
