The Directorate of Criminal Investigations (DCI) has recommended charges against Embakasi Central MP Benjamin Gathiru and Embakasi North MP James Gakuya over their alleged role in organizing anti-government protests in June 2024.
Intelligence reports suggest that the two lawmakers, who are close allies of deputy president Rigathi Gachagua held several meetings at a well-known hotel in Nairobi to plan the demonstrations to destabilize the country.
The MPs are facing charges that include soliciting or inciting others to commit offenses, in violation of Section 391 of the Penal Code, as well as conspiracy to commit a felony under Section 393.
Additional charges related to money laundering have also been levelled against them under the Proceeds of Crime and Anti-Money Laundering Act.
On July 31, the DCI summoned both MPs to record statements, but they reportedly refused to surrender their mobile phones for forensic analysis.
The DCI has since obtained a court order to access their phone records and financial data from relevant banks and service providers.
However, the MPs filed a counter-court order to prevent access to their mobile data.
James Gakuya confirmed that during his questioning, he was asked about meetings with various individuals at a hotel in Nairobi.
These developments point to the broader inquiry into the organization of the protests, and further investigations are ongoing.
