The Director of Public Prosecutions (DPP) has filed an application in court seeking to withdraw charges against 13 suspects linked to the theft of Ksh.122 million from the Government Advertising Agency (GAA).
During the mention of the case on Tuesday January 30, 2024 the court was told that apart from the 13, charges against other suspects will proceed to conclusion.
Kakamega County deputy governor Ayub Savula is among the suspects implicated in the Ksh122 million scandal at GAA.
The 13 suspects are Ishiundu Itemere, Amos Matanga, Hannah Wangari, Edith Kinda, Gladys Bwora, Gladys Isaka, Agren Jessica Ateko, Rachel Wanjiru, Martin Njoroge, Nelly Nachomba, Sammy Makau, Edmond Njenga and Victor Owino.

Kakamega deputy governor Ayub Savula and former ICT Principal Secretary Sammy Itemere are the main suspects accused of stealing Ksh122 million meant for paying advertisers.
The DPP’s new application emerged after some of the accused persons linked to the case requested the DPP in 2023 to review the charges.
After reviewing the request, the DPP acknowledged that there is new and sufficient evidence that is crucial to the case.
“The new information is significant and is likely to affect the cause of this hearing and it’s on this basis that we ask this court to grant us two weeks to consult with the accused persons’ advocates,” the court heard.

At the same time, the DPP requested for two weeks to amend the charge sheet, after removing the names of the 13 suspects.
The court will give its ruling on whether to withdraw charges against the 13 people on February 8.
