The Anti-Corruption Court has on December 14, acquitted former Treasury cabinet secretary (CS) Henry Rotich and 8 others in Ksh65 billion Kimwarer-Arror dam scandal.
During the ruling, Senior Principal Magistrate Eunice Nyutu acquitted Rotich and 8 other co-accused persons due to lack of evidence.
“All the accused persons in this case are hereby acquitted under section 210 due to lack of evidence as a result of the reckless dereliction of duty by the prosecution,” the magistrate said.
According to the court ruling, Rotich did not have a case to answer in the Arror and Kimwarer dams scandal.

This was after Rotich on November 20 asked the court to acquit him, saying that no money was lost in the Arror and Kimwarer dams project.
The former Treasury CS and eight other suspects were arrested in July, 2019 by the Directorate of Criminal Investigations for allegedly embezzling funds meant for the two dams.

Rotich was arrested after the then Director of Public Prosecutions (DPP) Noordin Haji ordered for his arrest for flouting procurement laws and making irregular payments for the dams project.
At that time, Noordin Haji accused Rotich of exaggeration and payment of more money to the Italian firm for the two dams.

Meanwhile, Rotich was happy that the case that had been going on for years was finally over.
