Joseph Kuria Irungu popularly known as Jowie has filed a notice with intentions to appeal against the death sentence he received in connection with the murder of businesswoman Monica Kimani.
In a notice through his lawyer Andrew Muge, Jowie claims that the sentence issued by the High Court on March 13,2024 was severe and violated his constitutional rights deeming it as cruel and inhumane.
“Take notice that Joseph Kuria Irungu alias Jowie, appeals to the Court of Appeal against the decisions of the honorable Lady Justice Grace Nzioka delivered in open Court at Milimani, Nairobi on February 9, 2024 whereby the appellant was convicted of murder and sentenced to death on March 13, 2024,” the notice stated.
During the sentencing, Lady Justice Grace Nzioka ruled that the Monica Kimani murder was not out of provocation and that the heinous act was planned, intended and executed before imposing a death sentence on the 33-year-old.
Jowie wants a declaration that section 379(4) of the Criminal Procedure Code is unconstitutional, null and void to the extent that it denies persons sentenced to death the right to bail pending appeal.
Additionally, he wants compensation “for infringement of his rights under Articles 27, 28, 29, 48 and 50 of the Constitution of Kenya.”
