Justice Lenaola defends Supreme Court’s role in safeguarding democracy

Supreme Court Judge Isaac Lenaola has reiterated the court’s pivotal role in upholding democracy, emphasizing its duty in constitutional interpretation and impartial justice.

Speaking at the University of Embu during the “Supreme Court at 12” commemoration, he highlighted the institution’s responsibility in preserving democratic values.

Lenaola noted that an independent judiciary is fundamental to democracy, citing the Supreme Court’s transformative impact, particularly after the historic 2017 presidential election annulment.

He clarified that the court’s jurisdiction extends beyond presidential disputes to gubernatorial, parliamentary and county elections, as well as gender equality in political representation.

The lecture also addressed judicial integrity in governance, referencing the impeachment of county governors and the role of independent bodies like the Independent Electoral and Boundaries Commission (IEBC) in maintaining accountability.

He condemned unconstitutional power grabs in Africa, emphasizing the judiciary’s role in ensuring free and fair elections.

Lenaola also responded to a petition seeking the removal of Supreme Court judges, warning that such actions could undermine Kenya’s democratic foundations.

He urged future legal professionals to uphold justice and constitutional integrity, reflecting on the country’s progress since the 2007 post-election violence.

His address reaffirmed the Supreme Court’s commitment to fairness, justice and the rule of law, reinforcing its role as a pillar of democracy in Kenya.
