Kakamega Senator Boni Khalwale has filed a petition at the United Democratic Alliance (UDA) party disputes resolutions committee seeking the removal of secretary general Cleophas Malala.
Khalwale has joined another UDA member Walter Mkinginyi in accusing Malala of misusing his leadership position in the party to mismanage the ruling party.
Khalwale is accusing Malala of usurping the authority of UDA National Elections Board by appointing county and regional administrators to oversee party elections on December 9.
“The Respondent overstepped his mandate and usurped the roles and mandate of the National Elections Board.
“The Petitioners will suffer irreparable personal loss and prejudice if the Honorable Committee does not intervene,” Khalwale and Kinginyi noted in their petition.
Khalwale maintained that the UDA secretary general did not involve other party members and officials in appointing officials who will conduct party elections at county and regional level.
The two petitioners are now demanding that Malala should produce evidence of involving the National Elections Board and National Executive Committee in appointing the elections officials.
“By overstepping his mandate and usurping the mandate of the National Elections Board, it is quite clear that the Respondent is bent on compromising the process by appointing his cronies and friends as election management officials,” read part of their petition.
They have also claimed that Malala has picked his friends and business partners to manage the elections, a move they say would affect the credibility of the party election outcomes.
“Some of the appointees such as the ones for the Western Region, Nairobi and Vihiga were based on the previous relationship between the Respondent and the appointees,” the petitioners told the committee.

They are now seeking the intervention of the committee to suspend Malala from Office and bar him from conducting official duties of UDA.
The petition was filed at a time when Malala clashed with Khalwale over a suggestion that other Kenya Kwanza affiliate parties should fold up and join UDA.
Khalwale was accusing Malala of lacking capacity to order Ford Kenya, ANC and other political parties within Kenya kwanza to join UDA.
