Faith Odhiambo, the President of the Law Society of Kenya (LSK) and a respected lecturer at the University of Nairobi’s School of Law, has strongly criticized the arrest of Grace Mulei, a 61-year-old protester.
Mulei was apprehended for allegedly causing a public disturbance during a demonstration at the Ministry of Health offices on January 15, 2025.
Odhiambo, has been vocal about the legal and ethical implications of Mulei’s detention.
She labeled the arrest as a blatant affront to Kenya’s Constitution and the principles of justice.
“The persecution of Grace Mulei for demanding government accountability is an insult to our Constitution and the rule of law,” Odhiambo asserted.
“Her arrest is not only substantively flawed but also carried out in a manner that disregards the inherent dignity of every person, particularly vulnerable members of society.”
Mulei’s alleged offense of causing a public disturbance carries a maximum penalty of a fine or six months’ imprisonment.
Article 49(2) of the Kenyan Constitution explicitly prohibits the remanding of individuals accused of such offenses in custody.
Despite this, Mulei remains detained at Capital Hill Police Station, awaiting a court appearance.
Odhiambo also highlighted the procedural lapses by the Directorate of Criminal Investigations (DCI) and the National Police Service (NPS).
“The actions of the DCI and NPS violate not just the Constitution but also the Police Service’s own standing orders,” she noted.
As an advocate for justice and equity, Odhiambo pledged the full support of the LSK in securing Mulei’s release.
“The LSK will provide legal assistance to ensure that Grace Mulei’s rights are upheld and that justice is served,” she affirmed.
The arrest has drawn public backlash, with many Kenyans expressing solidarity with Mulei.
They see her as a symbol of courage in the face of systemic failures and inefficiencies within the health sector.
