A Malindi court has handed a life sentence to Barack Kitsao for committing incest with his siblings.

Kitsao was convicted of four counts of incest involving his siblings, aged between 3 and 12 years. He was charged under Section 20(1) of the Sexual Offences Act, No. 3 of 2006.

Principal Magistrate Joy Shiundu ruled that the prosecution presented solid evidence. The court found that Kitsao knew the victims were his siblings and that he was their elder brother.

“The prosecution proved its case beyond a reasonable doubt,” Magistrate Shiundu declared. She sentenced him to life imprisonment for each of the four counts.

The offences took place in Malindi Sub County, Kilifi County, between May 8, 2023, and June 30, 2023. Kitsao assaulted his three sisters and two brothers during this period.

The accused claimed he was framed due to a conflict with the village elder. However, the court dismissed these claims.
The case was prosecuted by Benjamin Wambua. Kitsao is also facing a fifth charge of incest in a separate case.
