A few days after the Supreme Court declared the Housing bill null void and unconstitutional, salaried Kenyans have faced the wrath of it.
On Tuesday 30th 2024, Saboti Member of Parliament Caleb Amisi expressed his frustration to the President for defying court orders.
In a post shared in his X (twitter) page, Amisi shared his payslip, having been deducted the housing levy.
“Dear President Ruto, immediately you land from Rome I want you to tell me where to find you to get back this housing levy that you have already deducted from this month payslip in total disregard of the court subpoena,” read a part of the statement.
“I need the money urgently to pay the fees of one of the many needy bright students that I have been educating but currently stuck at home.”
Court declared Housing levy unconstitutional
The High Court on Tuesday, November 28 declared the Housing Levy as unconstitutional, null and void.
While delivering its ruling, a three-judge bench led by Justice David Majanja prohibited the government from collecting and or charging it from Kenyans’ salaries.
“The levy against persons in formal employment to the exclusion of other non-formal income earners without justification is discriminatory, irrational, arbitrary and against the constitution,” Justice Majanja said in the ruling.
However, the government has yet again ignored the verdict as Kenyans receiving salary have been taxed for the affordable housing.
