Tiaty Member of Parliament William Kamket has petitioned the Ministry of Interior and the Office of Attorney General over the gazettement of Kapedo and Mukutani as the headquarters for Suguta and Ilchamus sub-counties respectively.
Appearing before the Kabarnet High Court, Kamket filed the case arguing that the creation of Kapedo as the headquarters for Suguta Sub-County unlawfully alters the boundaries of Tiaty Constituency.
Kamket further noted that Interior Ministry overstepped its mandate as the issue of boundaries demarcation is a sole responsibility of the Independent Electoral and Coundaries Commission (IEBC) and had no jurisdiction to gazette the two sub-counties.
He claims that this move to alter boundaries indirectly infringes on the rights of Tiaty residents to fair administrative action.
On Mukutani, the MP says the boundary between Tiaty and Baringo South is an act which ultra vires as it is against the statutory provisions of the National Coordination Act which only mandates the Independent Electoral and Boundaries Commission (IEBC) to alter boundaries of constituencies.
Kamket describes the gazettement as illegal calling on the Ministry of Interior and National Administration to halt its implementation until the court case is heard and determined.
Justice Rachel Ngetich will give a ruling on the matter 20th March 2025.
