Mwingi businesswoman angered by courts for dismissing case against MP

A businesswoman from Mwingi, Kitui County is devastated after the courts dismissed her lawsuit against a legislator.

Rhoda Musyoka, a trader in Mwingi, sued Mwingi Central Member of Parliament (MP) Gideon Mulyungi for allegedly assaulting her.

Speaking to journalists outside Kitui Law Courts on Friday, March 1, Musyoka accused the courts of unfair dismissal of her case.

The magistrate threw out her petition stating there was insufficient evidence to proceed with the matter. Rhoda Musyoka however vowed to appeal the case.

Case Files Disappear

She reportedly presented the court with CCTV footage from the hotel premises where she was assaulted by the lawmaker and “his goons”.

“I’m very annoyed, I was attacked by Gideon Mulyungi in my hotel where he beat me. I filed a case and investigations were done for three months, they asked for all the evidence they wanted and we gave them. 

“At some point, my file was hidden and I was taken in rounds on the whereabouts of my file for close to five months,” the businesswoman claimed.

Rhoda Musyoka would allegedly learn later that the case was ongoing without her knowledge and only got wind of the issue close to its dismissal.

“I realized that money has exchanged hands but I deserve justice because I don’t get how my case can be thrown out yet there is evidence and witnesses,” she added.

Mwingi residents protest against MP

She called on human rights organizations to help her fight the “powerful” MP, claiming he was already threatening her.

“I will not relent even if he kills me, he has been inciting bodaboda guys to chase me from Mwingi but I am a mother, a trader, and deserve justice, he is not above the law,” Rhoda added.

Last year, locals took to the streets demanding arrest of the MP as they escorted the businesswoman to a nearby police station to record a statement after the incident.
