NCIC issue a warning letter to Gachagua over hate speech remarks

The National Cohesion and Integration Commission (NCIC) has issued a notice to former Deputy President Rigathi Gachagua, cautioning him against making remarks that contravene the National Cohesion and Integration Act No. 12 of 2008.

This is after the former deputy president alleged that he will mobilize citizens to protest if Chief Justice Martha Koome is removed from office.

In a statement released on Monday March 3, 2025, the Commission emphasized the importance of responsible speech, urging all leaders to promote unity and national cohesion.

“Your allegation that there is a scheme hatched by the President to remove the Chief Justice from office because of her ethnicity is misleading and meant to promote negative ethnicity and likely to incite feelings of animosity among Kenyans thus undermining peaceful co-existence.

“We continue to urge all Kenyans to uphold tolerance and respect, regardless of their political or social differences,” the NCIC statement read in part.

The notice follows a series of public remarks by Gachagua that the Commission believes may fuel division and threaten peaceful coexistence among Kenyan communities.

While the NCIC did not specify the exact statements in question, the Commission reiterated its mandate to take action against individuals who violate laws aimed at fostering national unity.

Political analysts have weighed in on the matter, with some calling for a more inclusive approach to addressing political tensions in the country.

“Leaders should be at the forefront of preaching peace and setting an example for their supporters,” said political commentator Dr. Josephine Awuor.

Meanwhile, supporters of Gachagua have dismissed the NCIC’s move as politically motivated, arguing that he is being targeted for expressing his views.

However, legal experts warn that public figures have a responsibility to adhere to laws that regulate speech and prevent incitement.

The Commission has affirmed that it will continue monitoring public discourse and take necessary actions against any statements that undermine Kenya’s stability.
