Isaac Mwaura reinstated as a Senator

Isaac Mwaura has been reinstated as a Jubilee Party nominated Senator.

Mwaura had lost his seat after the ruling party expunged his name from the party membership list.

But in a communication to the fifth session of Parliament on Wednesday, Senate Speaker Ken Lusaka said the decision to reinstate Mwaura follows the High Court ruling that earlier quashed a Gazette Notice that declared seat's vacancy.

"The High Court having quashed Gazette notice number 4597 by the Speaker of the Senate that declared a vacancy of a member elected through a party list, thereby removing senator (Dr) Isaac Mwaura as a senator...

"...and further the High Court having quashed gazette notice no. 4598 dated May 11, 2021, by the chairperson of IEBC which appointed Mr Sammy Prisa Leshore to replace Isaac Mwaura as a member of the senate representing PWDs, I therefore direct that Isaac Mwaura Maigua, CBS, MP, remains as Senator in accordance with the Constitution of Kenya and the Senate Standing Orders," said Lusaka.

Jubilee had already nominated Leshore to take over the seat but he was yet to be sworn in as a court order stopping his oath-taking was in place.

Nominated Senators Naomi Waqo, Falhada Iman, and Bomet Senator Christopher Langat escorted Mwaura to the chamber after his reinstatement.

Court's ruling

On Thursday, Justice Joseph Sergon ruled the Political Parties Disputes Tribunal proceedings show that Jubilee failed to ascertain how Mwaura was disloyal to the party.

The judge also faulted the tribunal for agreeing that Jubilee was justified to expunge Mwaura's name from the membership list.
