In Summary
- Raila Odinga and Martha Karua's lawyer Phillip Murgor says their team is yet to be given full access to the 8 IEBC servers, despite the commission saying the opposite.
- Murgor says that they suspect that IEBC is currently deleting vital data from its servers.
Senior Counsel Phillip Murgor - representing petitioner Raila Odinga and Martha Karua - on Thursday morning alleged that their team had observed a number of deletions in the Independent Electoral and Boundaries Commission servers.
Speaking before the start of the second day of hearing of the presidential petition, Murgor told the seven Supreme Court judges that IEBC has only granted the Azimio team limited access to its servers.
"I wish to report that as of this morning, nothing has changed. IEBC continues to refuse to provide the forensic image of all 8 servers. With the limited access provided to server 5, our team observed a large number of deletions.
"So we suspect and we are concerned that the delay on the part of IEBC is to delete vital data and when time runs out not to provide information that we require or provide logs that are of no use," Murgor said.
However, the Supreme Court dismissed the claims saying that IEBC complied with the law last evening.
"We have been informed that the process of compliance was completed last night. As far as the court is concerned, the process at IEBC is complete and re-counting at Forodha House is soon coming to an end," Justice Isaac Lenaola recounted.
Yesterday, IEBC said that it had complied with Supreme Court's directive and issued access to its servers.
"Following the Supreme Court order, IEBC has granted access to the parties to access the servers and the scrutiny exercise is ongoing," the electoral commission says on its official Twitter account.
