A 22-year-old man from Kakamega County will serve a 40-year jail term after being found guilty of defilement, sodomy and incest.
The man, identified only as Barasa, committed the crimes against his 10-year-old niece. According to court documents, the minor testified that she had been sent by her grandmother to borrow a sufuria from a neighbour when she bumped into her uncle.
Barasa is said to have lured her to his home where he performed the heinous act and threatened to kill her if she told anyone.
She came back home crying raising an eyebrow, upon the grandmother inquiring she narrated what had happened.
The grandmother also noticed the minor was unable to walk properly, she immediately rushed her to hospital.
The clinical officer who attended to her, Philip Okapesi, told the Kakamega court that the minor had indeed been assaulted sexually.
Members of the community however pleaded with court to give the perpetrator a non-custodial sentence adding that they would support his rehabilitation.
Court denied their request arguing that there was no guarantee that the offender would not commit the same crime to the victim or other children.
