Mombasa court dismisses appeal by man jailed for life for defiling nine-year-old girl

The High Court in Mombasa on Thursday, May 18 dismissed an appeal by a man jailed for defiling a nine-year-old girl three years ago.

Lady Justice Anne Ong’injo dismissed Nyawa Mwabugu Mricheni’s appeal for lack of merit and upheld the prosecution’s case.

The judge dismissed the appellant’s all grounds of appeal, including his assertion that the prosecution witnesses gave contradictory testimonies. The High Court ruled that there was no contradiction in the prosecution case and that the appellant was properly identified.

The case was tried by Shanzu Senior Resident Magistrate Hon. David Odhiambo, who heard the case, convicted and sentenced him to life imprisonment. In the appeal, the prosecution was represented by Prosecution Counsel Bernard Ngiri.

However, Hon. Ong’injo substituted the life imprisonment with a 25-year jail term, stating that the appellant had been in custody during his trial.
