Following months of back and forth over the leadership of East African Portland Cement, embattled Managing Director Bruno Oguda Obodha can now breathe a sigh of relief after petitions filed against him were withdrawn.
Oguda’s appointment by President William Ruto on 20th December 2024 as the new East African Portland Cement Managing Director was opposed by a petitioner, Caroline Wambui Mwangi who filled a petition against his assumption to office at the Hight Court, on grounds that his appointment lacked transparency and was subject to conflict of interest.
However, Mwangi withdrew the entire petition filled at the High court Kenya through an application dated 2nd January 2025, with no orders as to costs.
In the court directions given by Justice Bahati Mwamuye, the directions stated, “I have no reason to find that this matter was not public interest litigation, was filled in pursuit of a narrow private interest, or was filled mischievously ,vexatiously, or as an abuse of the court process”.
“Noting the foregoing and also noting the constitutional imperatives that guide this court to foster expeditious and pacific settlement of disputes outside of court, I make no orders as to costs.”
Oguda, through his advocate Aggrey Kenyatta, has expressed relief and gratitude to the President for appointing him despite weeks of court cases that prevented him from working.
Kenyatta noted that Oguda has assumed office and is ready to work for the Kenyans at the East Africa Portland cement reiterating support for staff at East African Portland cement.
