Supreme Court blocks lawyer AhmedNasir from Ksh2 billion land case

The ban on lawyer AhmedNasir Abdullahi from appearing before the Supreme Court took effect on Tuesday January 23 during a virtual hearing over a Ksh2 billion land case.

The Supreme Court led by Chief Justice Martha Koome declined to proceed with the case until the lawyer exits the proceedings.

AhmedNasir has been defending an Eldoret family in a case against the family of the late President Daniel Toroitich Arap Moi.

The court was clear that it will not continue with the case if the lawyer is part of its defense.

The court adjourned the case with 6 other judges removing themselves from the legal battle as long as AhmedNasir is part of it.

Senior Counsel Ahmednasir Abdullahi and his law firm was barred from appearing before the Apex Court for his instant attacks on the judiciary through social media.

This has since been adopted as a court order.

Lawyer AhmedNasir’s response

AhmedNasir in his response said that he will not take a brief or appear before the Supreme Court as long as CJ Koome, DCJ Mwilu, Smokin Wanja and Njoki are judges of the Supreme Court Kenya.

The lawyer noted that he will come back to the Court if and when Justices Ibrahim, Lenaola, Ouko and other new members constitute a majority in the Supreme Court.

”Now that @CJMarthaKoome today read the order of the Court where 6 judges recused themselves from the case I was to argue and further baring me from the court as long as they are members of the Court.

”I am ready to make peace with the court,” read a part of the statement.

Why AhmedNasir was barred from appearing in Court

The Court through it’s registrar on January18, 2024 declared, ”From the date of this Communication, you shall have no audience before the Court, either by yourself, through an employee of your law firm, or any other person holding brief for you, or acting according to your instructions.”

”Over the years, you have relentlessly and unabashedly conducted a campaign in the broadcast, print and social media aimed at scandalizing, ridiculing and out rightly denigrating this Court.”

The Court noted that the 2018 warning issued to the lawyer did not deter him.
