Two individuals sentenced to 19 years in prison for conspiracy to commit terrorism

Milimani Senior Principal Magistrate Hon. Zainab Abdul has today sentenced two men convicted of conspiracy to commit a terrorist act in Kenya using a vehicle-borne improvised explosive device to 19 years imprisonment and one woman convicted of forgery to 3 years imprisonment.

Abdimajit Hassan Adan and Mohamed Osman Nane were convicted on nine counts, including being in possession of weapons for terrorism purposes, being members of a terrorist group Al Shabaab and other charges related to the act, while Lydia Nyawira was convicted for forgery.

Hon. Zainab had imposed a 25-year sentence on Adan and Osman but considered the six years they have been in custody as the trial was ongoing.

Lydia Nyawira was sentenced to 3 years for the crime of forgery and facilitation of fake national identity cards that were used by the terrorists to commit the crimes.

In her sentencing, Hon. Zainab Abdul noted that, from the prosecution’s case, there is no doubt the offences committed were serious in nature and that a non-custodial sentence could not be meted out in such a case.

During sentencing submission, the prosecution led by Mr. Allen Mulama stated that, through the evidence provided by a bomb expert, if the VBIED was mounted anywhere in the CBD, the kill range would have been 100 meters.

The prosecution presented 46 witnesses in the case. The convicts have a right of appeal in 14 days.
