Two wives clash over the burial of their 100-year-old husband

KENYA

Two wives have taken their legal battle to court to halt the burial of their 100-year-old husband.

Grace Rigiri, the first wife of the deceased, Silas Kamuta Ingwetgay, secured a court order to stop the burial, arguing that she was married to him and that he should be buried at her home in Embu County.

The second family, represented by the wife Sarah Kathambi, said that Silas had separated from Grace over 40 years ago, so she had no authority to decide his place of burial.

“For 40 years, it was clear that the deceased had no relationship with the first wife and had no intention of returning,” Kathambi submitted.

Kathambi stated that before Silas died, he had left a will indicating his wishes, which they intend to honor.

She urged the court to allow her to bury her husband at their home in Lairang’i Mumui, Embu County as per his wishes.

According to the second family’s lawyer, Danstan Omari, they had spent over Ksh.5 million treating Silas during his illness, while the first family did not contribute anything.

The matter will be heard in court on Wednesday February 28, 2024.
