A Naivasha court has issued a warrant of arrest for Paul Mukumu Mbugua, a man accused of killing his nephew, Dennis Kennedy Mbugua.
Mbugua failed to appear in court today, violating the conditions of his release, which required him to report to the investigation office.
During the court session, Mr Ombajo, state counsel revealed that Mbugua’s mobile phone had been inactive, prompting the state counsel to seek a warrant of arrest, however the defense argued against the warrant, citing this as the first instance of Mbugua missing court.
further, Mr Festus Mbati lawyer for the victim’s told court that there were discrepancies regarding the passports deposited by the accused. indicated that the passport numbers did not match those provided by the investigation officer.
Additionally, lady justice Grace Nzioka was told that the second accused Paul Mukumu Mbugua’s USA passport was allegedly missing from the registry’s records , while the first accused John Kirika submitted a copy of his New Zealand work visa instead of the original.
Festus Mbati, the lawyer representing the victim’s family, raised concerns and requested the court to have the travel documents verified by the deputy registrar.
The defense strongly opposed, terming these allegations as serious and demanding them in writing for an adequate response.
Lady justice Grace Nzioka directed the investigation officer to submit an affidavit outlining the discrepancies, allowing all parties an opportunity to respond.
The matter is scheduled for further orders on February 1st.
In the matter John Kirika and Paul Mukumu Mbugua are jointly charged with the murder of Dennis Kennedy Mbugua on January 13, 2023, in Miti Mingi sub-location, Gilgil sub-county, within Nakuru county. Both accused parties have denied the charges and were released on a bond of Ksh 2 million.
