The case in which former Treasury Cabinet Secretary Henry Rotich and others have been charged over the KSh63 billion Arror and Kimwarer dams scandal has yet again failed to continue.
This is after the prosecution on Monday, October 2 failed to lead one of its witnesses to the stand, even as it emerges that witnesses are withdrawing from the case without testifying.
The prosecution told the court to grant at least 14 days to allow the new Director of Public Prosecutions (DPP) Renson Ingonga review the case and give further directions.
“The DPP was sworn in last week. I will not tire to make my request about the outcome. Allow me to ask for 14 days to enable him sit down and give a direction on the file,” the lead prosecutor pleaded with magistrate Eunice Nyutu.
Magistrate ‘frustrated’ by prosecution
Although the defence did not object to this plea, Magistrate Nyutu said the reasons given did not merit to adjourn the matter, directing the witnesses to testify.
However, prosecution said it had no questions to the two witnesses present to testify.
Consequently, the court adjourned to Tuesday, October 3.
